When leasing a cold regeneration machine, there is no fixed standard for the party responsible for fuel and operator fees, which mainly depends on the provisions in the lease contract. Here are some common situations:
Fuel cost
Lessee's responsibility: If the contract does not mention fuel costs, they are usually borne by the lessee. Because cold regeneration consumes fuel during the lessee's use, it is reasonable for the lessee to bear the responsibility. In some leasing scenarios, such as the leasing of road surface cold recycling machines for the Majiabao Jingyang Expressway project of China Communications Second Highway Engineering Co., Ltd., it is explicitly stipulated that fuel costs and other expenses are borne by the lessee.
The lessor shall bear: If the contract clearly stipulates that the rent includes fuel costs, then the fuel costs during the lease period shall be borne by the lessor. This kind of agreement is common in situations where the rent is relatively high and the lessor wishes to simplify the cost settlement.
Operator fees
The lessor shall bear: Generally speaking, the operator establishes a labor (or service) relationship with the lessor, and the lessor shall pay for wages, benefits, social insurance, and other expenses. For example, in the cold regeneration machine leasing project of China Communications Second Highway Engineering Co., Ltd. Sixth Engineering Co., Ltd., it is required that the equipment be accompanied by a driver, and the driver's salary expenses are borne by the lessor.
Lessee's responsibility: In some cases, the lessee may also bear the operator's fees, such as when both parties agree in the contract that the lessee shall pay additional wages or subsidies to the operator, or when the lessor's quotation clearly states that the operator's fees shall be borne by the lessee separately.
In short, when leasing a cold recycling machine, both parties should clearly stipulate in the lease agreement the party responsible for bearing the fuel and operator fees to avoid potential disputes in the future.
